Divorce in Germany for expats follows the German Civil Code (BGB). A mandatory 1-year separation period (Trennungsjahr) “from table and bed” is required before filing a petition in the Family Court (Familiengericht). Keeping Your Residence Permit After Separation: Section 31 AufenthG
A critical fear for many expats is losing their visa. If your marriage in Germany lasted at least 3 years, you are entitled to an independent right of residence under Section 31 of the Residence Act (§ 31 AufenthG).
Particular Hardship and Domestic Violence Protections
If you are suffering from psychological or physical abuse, you may qualify for the Particular Hardship (Härtefall) exemption under § 31 paragraph 2 AufenthG. This allows you to retain your independent residence permit extension even before the 3-year mark.

To legalize a foreign divorce decree in Germany to remarry or update civil registries, you must apply for recognition.
